General Terms and Conditions with Customer Information

1. Scope

1.1 These General Terms and Conditions in their current version at the time of the order apply exclusively to all contracts, deliveries, and services between repack much e.U., Walter Wittmann, Kreuttalstraße 4, 2123 Unterolberndorf, Austria, VAT ID: ATU69374517 (hereinafter “Seller”) and the customer (hereinafter “Customer”).

1.2 A consumer within the meaning of these terms is any natural person who concludes a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the exercise of their commercial or self-employed professional activity.

1.3 Deviating terms and conditions of the Customer do not apply unless expressly agreed to in writing by the Seller.

2. Offers and Product Descriptions

2.1 The products displayed in the Seller’s online shop are not legally binding offers but non-binding invitations for the Customer to place an order.

2.2 Product descriptions do not constitute guarantees unless explicitly stated as such.

2.3 All offers are valid “while stocks last,” unless otherwise noted. Printing errors, mistakes, and technical changes are reserved.

3. Order Process and Contract Conclusion

3.1 Customers can select products and collect them in a virtual shopping cart using the “Add to Cart” button. Products can be changed or removed at any time.

3.2 By clicking “Place Order,” the Customer makes a binding offer to purchase the items in the cart.

3.3 The Seller confirms receipt of the order via email (order confirmation), which does not constitute acceptance. The contract is only concluded when the Seller ships the goods within two working days or explicitly confirms the contract (e.g., via order confirmation or invoice).

3.4 For business customers, the acceptance period is seven days.

3.5 When choosing prepayment, the contract is concluded once the payment information is provided. If no payment is received within ten calendar days, the Seller may cancel the order.

4. Prices and Shipping Costs

4.1 All prices shown are exclusive of Austrian VAT. VAT is shown separately during checkout and added to the total.

4.2 Additional shipping costs apply and are clearly communicated before finalizing the order. Costs depend on destination country, weight, and volume.

5. Delivery and Product Availability

5.1 Shipping takes place worldwide, with a focus on Europe, from the warehouse location Dassanowskyweg 16a, 1220 Vienna, Austria.

5.2 Orders are generally processed by 5:00 p.m. the following day. DPD and GLS shipments typically take 1–3 working days.

5.3 Orders over 100 units (or fewer in exceptional cases) are shipped via freight forwarding. Shipping is initiated within 48 hours of payment and usually delivered within 3 working days (up to 12 days total).

5.4 If delivery fails due to incorrect address, missing phone number, refusal, or absence, a return may occur. A 10% restocking fee plus shipping costs will apply.

5.5 Shipments travel at the Customer’s risk. Transport damage must be reported directly to the courier upon receipt.

5.6 Offers are subject to prior sale. Compensation for delivery delays or unavailability is excluded where legally permitted.

5.7 For business customers, the risk passes to the Customer upon handover to the carrier.

5.8 Delays due to force majeure or unforeseen events entitle the Seller to an appropriate delivery extension. In long delays, the Customer may cancel the order.

6. Payment Terms

6.1 Accepted payment methods:

  • Credit/Debit Card
  • American Express
  • PayPal
  • Bank Transfer (Prepayment)
  • Cash on Delivery (Austria only)

6.2 In the case of advance payment, the amount is to be transferred to the account specified in the order confirmation before shipment. In the case of cash on delivery, payment shall be made to the deliverer. Payment is to be made net without discount. The amount of money must be handed over to the deliverer exactly to the cent.

6.3 Payment is considered complete upon receipt by the Seller. The Customer bears the payment risk.

6.4 In case of default, statutory interest may be charged. Further claims remain unaffected.

7. Retention of Title

Goods remain the Seller’s property until fully paid. In case of resale, the Customer must inform the buyer about the retention. Sale proceeds must be forwarded to the Seller. Pledging or transferring ownership as collateral is not permitted.

8. Customer Account

8.1 Orders can only be placed with a registered customer account. Guest checkout is not available.

8.2 Customers must provide accurate registration data and keep it up to date.

8.3 The Seller may suspend or delete accounts in cases of misuse.

9. Warranty and Guarantee

9.1 Statutory warranty rights apply.

9.2 Our Woodbags are guaranteed for 18 months from the date of production. Each bag is provided with a label for tracking purposes.
IMPORTANT!!!: After 24 months from the production date (see label in the Woodbag), any complaint or warranty is excluded – the maximum period of use of the bag has then expired, or is already 6 months over the 18-month warranty period.

9.3 Entrepreneurs are obliged to inspect the goods immediately upon receipt and to report any recognizable defects in writing within two weeks. In the event of justified notification of defects, the seller may choose between repair or replacement. Farmers are entrepreneurs.

9.4 Claims against the manufacturer exist only within statutory limits. Wear, misuse, or expired UV-sensitive goods are excluded from warranty.

10. Returns / Withdrawal

10.1 Customers have the right to withdraw from the contract under legal conditions (see cancellation policy).

10.2 Return address in case of withdrawal:

10.3 A return form is available as a PDF in the order history. Additional return information is on the “Cancellation Policy” page.

10.4 Unless otherwise stated, the Customer bears the direct cost of return shipping.

11. Product Safety Regulation (GPSR)

11.1 The Seller fulfills its duty to provide information under the General Product Safety Regulation (GPSR).

11.2 Product listings include:

  • Name and address of the manufacturer (or EU safety contact)
  • Electronic contact option (website or email)
  • Safety warnings and relevant information, if necessary

11.3 These details are clearly displayed in each product listing.

12. Liability

12.1 The Seller is liable without limitation for intent and gross negligence.

12.2 In case of slight negligence, liability applies only to breaches of essential obligations and is limited to foreseeable damages.

12.3 Further liability for indirect or consequential damages is excluded. Product liability law remains unaffected.

13. Contract Text Storage

13.1 Customers may print or save the contract text before placing the order.

13.2 After ordering, Customers receive a confirmation email with all relevant data, terms, cancellation info, and payment/shipping conditions.

14. Final Provisions

14.1 Austrian law applies, excluding UN sales law.

14.2 Jurisdiction for business customers is the competent court at the Seller’s location in Austria (District Court Mistelbach or Regional Court Korneuburg).

14.3 Contract language is German.

14.4 The European Commission provides a platform for online dispute resolution:

The Seller is not obliged and not willing to participate in such proceedings.
